StayQode terms and conditions
These Terms govern the StayQode platform, QR guest information, Wi-Fi access pages, consent forms and marketing services.

1. Scope
These Terms govern the use of the StayQode platform, including the QR-based guest information system, Wi-Fi access pages, guest consent forms, and any marketing services offered to property owners and partner businesses.
2. Parties
StayQode LLC is a Wyoming limited liability company registered at 30 N Gould St Ste N, Sheridan, WY 82801, United States. “Property Owner/Operator” means the entity or individual that lists a property using StayQode. “Guest” means an individual accessing a StayQode-powered page by QR code or link. “Campaign Client” means a business purchasing access to audience segments through StayQode or an affiliate.
3. Description of service
StayQode provides property owners with QR-code-based digital guides and an optional guest data collection form with marketing consent choices. Form fields, consent checkboxes and privacy notices vary by country according to the guest’s location, as set out in StayQode’s country-by-country consent specification and reflected in the Privacy Policy.
4. Guest obligations
Guests agree to provide accurate information when using the platform. Providing personal data for marketing purposes is always optional and never affects access to property information, including Wi-Fi, house instructions, house rules and useful contacts.
5. Property owner obligations
Property owners must use the platform for its intended purpose, hold the rights to content they upload, avoid unlawful use and, where they are a joint controller of guest data, cooperate with StayQode on guest rights requests within applicable legal deadlines.
SMS and WhatsApp messaging to guests located in the United States is disabled by default. A property owner may request an exception for a specific property only after demonstrating a verified consent mechanism obtained directly from the guest before the first message. Email communications to United States guests remain available.
6. Campaign and audience segment service
When a Campaign Client asks StayQode or its affiliate to deliver a campaign to a guest segment, StayQode retains control of the underlying personal data. Raw names, email addresses and phone numbers are never disclosed to the Campaign Client. The client receives only aggregated, non-identifying performance data such as opens or clicks. An affiliate executing a campaign acts as a processor under a data processing agreement unless the guest is told otherwise.
7. Country-specific compliance
StayQode applies country-specific wording, fields and additional steps automatically, including double opt-in for Germany and Canada and a separate cross-border transfer screen for mainland China. Property Owners and Campaign Clients must not bypass or alter this flow without StayQode’s written consent.
8. Intellectual property
StayQode platform software and branding remain the property of StayQode LLC or its licensors. Property owners retain ownership of content they upload.
9. Term and termination
These Terms remain in effect while a party uses StayQode. Either party may terminate in accordance with the applicable service agreement.
10. Liability
StayQode uses best efforts to provide the platform and is not liable for indirect, incidental or consequential damages. Nothing limits liability that applicable law does not permit us to exclude. To the maximum extent permitted by law, StayQode’s total liability will not exceed fees paid to StayQode in the 12 months before the claim.
11. Indemnification
Property Owners and Campaign Clients agree to indemnify StayQode LLC, its affiliates, officers and employees for claims, losses or expenses arising from content or campaigns they submit, their breach of these Terms or their violation of applicable law.
12. Minimum age
The Service is not directed at children. Use by anyone under 16, or a higher local minimum age where applicable, is prohibited. StayQode does not knowingly collect personal data from children.
13. Force majeure
Neither party is liable for failure to perform due to circumstances beyond its reasonable control.
14. Dispute resolution
Before formal proceedings, the parties will try to resolve a dispute by contacting [email protected]. If it remains unresolved after 30 days, either party may proceed under Section 15. Mandatory consumer rights remain unaffected.
15. Governing law and jurisdiction
These Terms are governed by Wyoming law. Proceedings must be brought in Wyoming state or federal courts, subject to mandatory consumer and data protection rights that cannot be waived in the guest’s or property owner’s country.
16. Changes to these Terms
StayQode may update these Terms. Material changes will be announced by email or a prominent platform notice at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.
17. Severability and entire agreement
If a provision is unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy and the country-by-country consent specification form the entire agreement regarding the Service.
